That sucks... it is stupid it is up to you(the individual) to make sure that the DVLA has done its job and updated their records.

hope you get it sorted!

Hmmm good question.

I think technically you will be liable, but if you have evidence to prove that you sold the car on that date you may have a chance.

On a side note... it took 3 letters and quite a few months before DVLANI actually accepted that i still had my car. :) They kept sending letters saying "Thankyou for notifying us about the sale of your vehicle..."

Yep, like i said, if you cant identify the new keeper, and have to go to court, I shall be available as a professional witness, and will stand up and tell them that you sold the car before xmas ( it was before wasnt it) and i know it wasnt you!

Not intending to worry you Vinny but if cannot prove you sold the car before xmas there is a chance that you will get done for it you can no longer claim you dont know who was driving IIRC PM AndyF he is a Traffic cop see if he has any advice for you

i even have texts on my phone, with him saying hi its craig i bought your car lol, then asking questions about a dump valve etc. Any way of finding personal details from a mobile number?

you should have done two identical receips. i always do two. one for the seller and one for the buyer. i always date it put the reg number of the car im selling and both addresses and make the buyer sign it and print there name. i then do the same, this is usally accepted as prof of sale is situations like this.

Keep the texts !!

Reply to the summons stating that the car was sold on (day / date / time) to (whoever you sold it to) and mention that you have texts confirming that information, and can call friends and family to court to give evidence if necessary to confirm that as the truth. State that you complied with the law in relation to informing the dvla of the change and the letter was sent to them on (date).

The trouble you now have is that the guy who was driving knows what's coming and will be "evasive" shall we say.

You'll be fine.

As i said, I will go to court with you should it be necessary. I know you sold it, and definitely didnt have it last weekend, so you should be fine.

As per my PM mate, send a letter back with the NIP giving all the details you have of the person you sold it to and the person he sold it to. If the car is insured in someone elses name (especially if it is in the name of the person you have mentioned) then you should be ok.
